General conditions
1.GENERAL CONDITIONS
1.1. The reservation of any of the trips whose technical organization is in charge of MOROCCO TRAVELS TOUR, entails the total acceptance of these general conditions, which will be considered automatically incorporated to the contract even if they are not transcript in the mentioned contract.
1.REGISTRATION TO THE TRIP
1.1. The act of registration to the trip and the consideration of reservation require that the client pay a deposit of 40% of the total amount budgeted, except in the case that the paying terms of the suppliers impose the advanced payment of another amount. In these cases the most restrictive conditions will apply, and the percentage of the reservation may exceed 40%.
1.2. The information contained in the technical sheet (travel proposal) that is initially provided has a generic nature and should be considered as provisional.
1.3. No significant variations in its content are to be expected beyond the adaptation of the services provided to the existing availability for each specific tour. The travel contract signed between the agency and the client incorporates the technical sheet with the final details concerning the route, price and services included.
CONTRATACIONES Y CONDICIONES DE PAGO
1.1. To formalize the reservation it is mandatory that the client provide us with the following information:
- NAME AND SURNAME
- DATE OF BIRTH
- CONTACT TELEPHONE
- INFORMATION OF FLIGHTS OR FERRY
1.2. We need a first payment of 40% of the total amount, except in the case that the paying terms of the suppliers impose the advanced payment of another amount. In these cases the most restrictive conditions will apply, and the percentage of the reservation may exceed 40%.
1.3. The final payment will be made as follows:
1.3.1. INDIVIDUAL DIRECT CUSTOMERS * (less than 10 people): The day of arrival in cash.
1.3.2. CUSTOMERS OF TRAVEL AGENCIES, COMPANIES OR GROUPS * (groups of 10 or more): The 70% will be paid 3 months before the arrival of the travellers, and the remaining amount (100%) will be paid 30 days before the arrival of the travellers by bank transfer.
1.4. The client has to take into account that until the Agency does not have confirmation of receipt of the trip deposit, no reservation will be made. All hotel and service reservations will be subject to availability at the time of confirmation, so we recommend that this be made as soon as possible. Therefore, the displayed accommodations can be modified and replaced by similar ones of the same category. Once the reservation is confirmed, we will inform you of the exact accommodation.
1.PAYMENT METHODS
Payments can be made via bank transfer or credit card:
1.1. BANK TRANSFER: We recommend that you check with your bank the conditions for international transfers to Morocco. Morocco Travels Tour is not responsible for bank fees or transfer fees. In case we receive in our account an amount lower than the total of the agreed trip, the difference must be paid at the beginning of the trip.
1.2. PAYPAL: We accept payments through PayPal. Morocco Travels Tour is not responsible for the commissions or expenses for transfers that the platform may require. In case we receive in our account an amount lower than the total of the agreed trip, the difference must be paid at the beginning of the trip.
1.3. The price of the TOTAL cost is in € (Euros). If the change in Moroccan dirhams or dollars varies, the corresponding change will be applied to the date of the draft to receive the exact amount in Euros.
1.CANCELLATION BY THE TRAVELER AND / OR CANCELLATION OF THE TRIP:
1.1. Cancellation conditions for individual trips:
- Management and reservation expenses (40% of the total amount).
- Cancellation costs (amounts to be paid to the different providers involved in the trip). The amount of these can be significant, since they include: hotels, expenses of local suppliers, etc., which may be non-refundable.
- Cancellation expenses on the total amount of the trip in case of cancellation by the client. The following amounts will be charged:
– From confirmation up to 30 days before arrival: total amount of deposit received (Non-refundable)
– Between 29 and 15 days before arrival: 50%. .
– Entre 14 y 7 días antes de la llegada: 80%.
– Less than 7 days before arrival, 100% of the total will be charged.
– In the event that the client does not show up at the scheduled date and time of the beginning of the trip, it will mean the total loss of the service or tour package.
1.2. Cancellation conditions for group travel and companies:
- Management and reservation expenses (40% of the total amount).
- Cancellation costs (amounts to be paid to the different providers involved in the trip). The amount of these can be significant, since they include: hotels, expenses of local suppliers, etc., which may be non-refundable.
- Cancellation expenses on the total amount of the trip in case of cancellation by the client. The following amounts will be charged:

1.ALTERATIONS AND MODIFICATIONS OF THE TRIP BY THE ORGANIZER
1.1. If before the departure of the trip, the Travel Agency is forced to significantly modify the essential elements of the trip, it must notify the client in writing as soon as possible, so that the latter can choose between canceling the reservation or the contract, or accepting the modifications of the trip initially contracted. In the event that the client does not communicate their decision in writing within three business days following the notification, it will be understood that they accept the notified changes.
1.2. If during the trip, the Travel Agency is unable to provide any of the services under the agreed conditions, the Agency will offer the user its substitution / compensation at the destination with another service of similar characteristics; or the cash refund of the cost of the service.
1.3. For those services mentioned as included in the trip and not made, the Agency will be responsible, as long as the client notifies us during the course of their trip to the assistance telephone (+212 667-969648). Once we have received the notification from the client, we will proceed to compensate the customer at the destination for a service with similar characteristics. If, due to the type of service, such compensation is not possible, the amount of the mentioned service will be refunded.
1.4. No refund will be made for services not used voluntarily by the customer, whatever the cause of the non-use.
1.5. Cases of force majeure (abnormal or unforeseeable circumstances beyond our control) or the adequacy of the route to a specific transport plan are considered sufficient causes for the modification of the trip.
1.6. If transfers from the hotel to the airport or vice versa or similar, included in the offer, are not met, mainly for reasons beyond the control of the transfer and not attributable to the Organizer, the latter will refund the amount of the alternative transportation used by the client in the trip, prior presentation of the corresponding receipt or invoice.
1.7. The temperature in winter can reach a maximum of 20 degrees and minimum of up to -5 degrees in some points of the route, and in summer a maximum of 47 degrees and minimum of 18 degrees. We recommend you to be foresighted in the face of any inclement weather (rain, wind, snow, heat, etc) and to check, a few days before traveling, the weather website in Morocco and the places that will be visited. The client can get informed about the climatological situation of the country of destination on the following sites: www.tutiempo.net / www.e-tiempo.com / https://wwis.inm.es. The client exempts the AGENCY from responsibility for the negative consequences that may arise from this circumstance.
1.RESPONSIBILITY OF THE ORGANIZING AGENCY
1.1. The organizing agency will be liable for the consequences arising from the non-execution of the contract in proportion to its involvement in the management of the combined trip.
1.2. However, it will be exempted from this responsibility either when there is a force majeure (abnormal or unforeseeable circumstances beyond our control, including weather conditions) or an event that neither the organizing agency nor the suppliers have been able to avoid, even having acted with due diligence.
1.3. It will also be exempted from liability when the cause is attributable to a client or a third party.
1.4. In the case of incidents in air transport (denial of boarding for any reason, cancellations, changes or flight delays, lost, delayed or damaged baggage, etc.) the client is responsible for managing the claim of their rights as a passenger in the same airport where the incident occurs. The costs of accommodation, transportation, meals, repatriation or other expenses caused by these incidents will not be the responsibility of the Organizing Agency.
1.5. When the trip is made in own vehicles or vehicles rented by the Organizing Agency, in case of accident the traveler is expressly subject to accident legislation in the country in which the vehicle is registered.
1.ANNULMENTS BY THE AGENCY: MINIMUM GROUP AND CAUSE OF FORCE MAJEURE
1.1. In the cases in which the completion of a trip is subject to having a minimum number of participants, and so specified, the Agency may cancel the trip in the event that this minimum number of participants is not reached, notifying it with a minimum of 15 days before the scheduled departure date.
1.2. Likewise, the Agency may also cancel a trip due to force majeure, understanding as such those circumstances unrelated to the party invoking them, abnormal and unforeseeable, whose consequences could not be avoided despite having acted with due diligence. In both cases, the consumer will be entitled to refund of the amounts paid, except for management expenses.
1.DOCUMENTATION
1.1. The client has the obligation to have in order the necessary documentation for the entry and free circulation in Morocco (Identity Number, passport, visas, sanitary measures, etc.). Regarding the consultations, Morocco Travels Tour acts as an informant, but it is the responsibility of the client to confirm before the competent authorities. The client expressly assumes the process for the obtaining of these documents, as well as the consequences derived from not obtaining them or from the fact that they are not valid.
1.2. It will be the responsibility of the client to verify the entrance requirements for Morocco according to their nationality, and they should contact the respective Consulates and / or Embassies to know and process the visas or entry formalities that they demand from our country, and assume the consequences of its breach.

1.3. Children under 18 years of age must carry a document authorizing them to make the trip, signed by both parents, by the custodial parent (in cases of separated or divorced marriages) or by the guardian.
1.4. In case the client, due to lack or incorrectness of the necessary documentation, is forced to cancel or abandon the trip, the Agency will apply the conditions indicated in the paragraph of cancellations.
1.LUGGAGE
1.1. The traveler’s baggage is not the subject of the land transport contract, it being understood for all purposes that the traveler always keeps it. The Organizing Agency is not responsible for any damage the baggage may suffer during the trip.
1.2. To customers who have booked a night in the desert of Morocco, we recommend that in the suitcase you use during your trip to Morocco you include a small cloth backpack to carry the change of clothes for the night spent in the desert. This way we will avoid the inconvenience of carrying heavy luggage in the middle of the desert, and will prevent your personal belongings from be damaged by sand.
1.ACCOMODATIONS
1.1. HOTELES/ RIADS: The quality and provision of the services of the accommodations will be determined by the official tourist category assigned by the competent body in Morocco, taking into account that this classification may involve notable differences in some cases. The categories of accommodation in Morocco do not always correspond to the categories used in western countries. Therefore, the Client must bear in mind that if we compare the category of accommodation in Morocco by its stars, it is likely to be equivalent to a lower category in the West
1.1.1. If the program that has been sent to the client includes dinner on the first day, the Client must take into account that this meal will not be provided for arrivals at the destination after 8:00 p.m. In this case, the cost of this service will not be refunded. If the hotel offers this service in an extraordinary way after this time, it will always be a cold meal.
1.1.2. The scheduled times for breakfasts, lunches and dinners in the hotels are those indicated by each hotel. Outside these times these services cannot be provided and will not be refundable.
1.1.3. Clients will have the rooms at their disposal after 3 pm on the check-in day and will leave them before 12:00 noon on the day of departure. You can leave your luggage in the luggage room at the accommodation.
1.1.4. Hotels can request the customer’s credit card at the check-in time, as a deposit to cover any expenses that may arise during the stay. We recommend that at the check-out time and before leaving the hotel, you request the receipt and check that no improper charge has been made on your account. We are not responsible for claims on these charges. 1.1.5. Las habitaciones triples en este destino son una habitación doble (1 cama de matrimonio o 2 camas) con un “plegatín”. No se admitirán reclamaciones posteriores a su viaje por este concepto.

1.2. RIADS: in Marrakech riads are the traditional accommodation of the ancient Marrakchis. They are charming hotels renovated for such purpose, located in most cases in the medina (old city inside the wall).
1.2.1. The vehicle usually does not reach the hotel/riad door. The transport reaches the closest point allowed for road traffic and then a trunk with a car is hired, which will take us to the RIAD. The price of the trunk service is around 20DH (2 € approximately) and it is not included in the proposal unless it is specified in the “Includes” section.
1.2.2. The rooms are usually arranged around a pretty courtyard with a fountain and decorated with mosaics. We can find riads in the main cities of Morocco. The riads usually have two or more floors with stairs. On the upper floors we will usually find the bedrooms, while the living rooms, the dining room and other rooms around the patio are usually on the lower floors. The riads can be of different types, from extremely luxurious -which make us feel we are in a real palace- to the simplest ones, which will not lack charm or comfort. People with reduced mobility should take into account the fact that stairs are everywhere, and that you have to walk to reach the Riad. Keep in mind that many Riads do not accept children under 14 years of age.
1.2.3. It is advisable to book them as soon as possible, as these accommodations are highly demanded during virtually the entire year and they have few rooms. They do not usually offer the option of Half board.
1.3. JAIMA – Typical tent of the desert nomads. In the programs that indicate the overnight stay in this type of accommodation, the client understands and accepts that it is a typical tent located in camps (without classification) that offer the minimum services as they are in the desert dunes. Bathrooms are shared (except for luxury category trips that have private bathrooms)
1.PRESENTATION AT THE DEPARTURE
1.1. We recommend the presentation to boarding at airports three hours before the departure of the flight. Passengers must reconfirm with this Travel Agency, within 48 hours prior to the scheduled departure, the meeting point, date, time and flight number. If this reconfirmation is not made, the Agency declines all responsibility in case of alterations on the information previously provided.
1.SPECIALTY OF THE ALTERNATIVE TRIP / REMOTE AREAS
1.1. The CLIENT is informed in this act of the special characteristics of the alternative trip that is acquired, especially of the weather conditions of the country of destination, of the possible technical limitations of the local professionals and the substantial differences in road and hotel infrastructure when compared to the conventional standard of western countries. The final itinerary detailed in the technical sheet is only tentative and the customer expressly accepts any changes that may occur on site due to weather conditions, unforeseen impositions by suppliers in the area or due to limited local infrastructure.
1.INSURANCE
1.1. We recommend that Clients hire travel insurance, as they are not included in our programs. If you wish, Morocco Travels Tour can advise you on the insurances available in the market, both for travel assistance and cancellation. Hiring an insurance is highly recommended in order to avoid expenses for medical assistance, repatriation or penalties in case of cancellations by justified causes. 1.MEDICAL ASSISTANCE AND POLITICAL AND SECURITY SITUATION OF THE COUNTRY OF DESTINATION
1.1. The Client must be aware that, in some cases, a quick evacuation or adequate medical assistance may be impossible.
1.2. POLITICAL SITUATION AND SECURITY: We refer to the official recommendations of the Ministry of Foreign Affairs of the Spanish Government that appear on its website https://www.mae.es.
1.3. HEALTH: We refer to the official recommendations on vaccines and necessary preventive measures of the Ministry of Health and Consumption that appear on its website https://www.msc.es
1.3.1. VACCINES: For any questions about the necessary vaccines and other health information for the trip, we suggest contacting the corresponding tropical medicine center in each town. The following vaccines are recommended in some communities: Typhoid Fever, Hepatitis A, Hepatitis B, Tetanus-Diphtheria.
1.4. Provided with this information, the traveler is aware of the social or political situation, safety and health of the country of destination, and accepts the risk that the trip could involve, exempting the Organizing Agency from any responsibility.

1.1. We inform you that the personal data that you provide will be incorporated and will be treated in order to meet your request and provide the requested service, as well as to keep you informed, including by electronic means, about issues related to the activity and its services.
